FSSAI (Food Safety and Standards Authority of India) Overview

The FSSAI (Food Safety and Standards Authority of India) Registration is a mandatory statutory license required by every individual or entity involved in the food supply chain.

Issued by the Ministry of Health and Family Welfare, Government of India through the modernized FoSCoS (Food Safety Compliance System) portal, this license ensures that food products undergo stringent quality checks and are safe for human consumption. Upon successful registration, the Food Business Operator (FBO) is issued a unique 14-digit FSSAI license number. This number must be prominently printed on all food packaging and displayed at the business premises to assure customers and authorities of your adherence to national food safety standards.

Who Needs This? (Mandatory Applicability)

If your business touches food in any capacity, you are legally classified as a Food Business Operator (FBO) and must obtain this license. It is strictly mandatory for:

• Eateries & Restaurants: Cafes, fine-dining restaurants, fast-food outlets, dhabas, and food trucks.

• Manufacturers & Processors: Any factory, slaughterhouse, or meat processing unit manufacturing packaged or loose food.

• E-Commerce & Cloud Kitchens: Sellers on Zomato, Swiggy, Amazon Pantry, Blinkit, and independent cloud kitchen operators.

• Home Bakers & Solo Caterers: Individuals cooking or baking food items from their home kitchens for public sale.

• Supply Chain Operators: Food importers, exporters, wholesale distributors, specialized transporters (refrigerated vans), and storage warehouses.

• Retailers & Grocers: Supermarkets, kirana stores, and sweet shops selling edible items.

Types or Classifications

FSSAI licenses are strictly categorized into three tiers based on your business’s annual turnover, production capacity, and geographical operational spread:

• Basic FSSAI Registration: For petty food businesses, small startups, home bakers, and retail shops with an annual turnover of up to ₹12 Lakhs.

• State FSSAI License: For mid-sized businesses, standard restaurants, and manufacturers with an annual turnover between ₹12 Lakhs and ₹20 Crores.

• Central FSSAI License: For large-scale enterprises with an annual turnover exceeding ₹20 Crores, 100% Export Oriented Units (EOUs), all food importers, and businesses operating in multiple states (the Head Office requires a Central License).

Validity & Renewal

• Validity Period: An FSSAI License/Registration can be issued for a flexible period ranging from 1 year to a maximum of 5 years, depending on the government fee you choose to pay upfront.

• Renewal Requirement: The license must be actively renewed no later than 30 days prior to its expiry date. Filing for renewal after this window attracts a daily late penalty of ₹100. If the license expires, you must stop all food business operations immediately and apply for a brand-new registration.

Penalties for Non-Compliance

The FSSAI department conducts random inspections, and operating without a valid license or selling substandard food carries severe punitive actions under the Food Safety and Standards Act, 2006:

• Operating Without a License: Punishable by imprisonment for up to 6 months and a hefty fine of up to ₹5 Lakhs.

• Sub-standard Food Sales: Selling food not up to the mandated safety standards can attract fines up to ₹5 Lakhs.

• E-Commerce Bans: Major food aggregators (Swiggy, Zomato, UberEats) will instantly terminate your vendor contract and delist your kitchen if your FSSAI license expires or is absent.

• Seizure & Closure: Food Safety Officers hold the authority to seize your inventory, seal your premises, and shut down your business immediately upon discovering serious compliance failures.

Required Documents Checklist

Documentation varies based on the tier of license. Please keep the following ready:

For Basic FSSAI Registration:

• Applicant KYC: PAN Card, Aadhaar Card, and a recent passport-sized photograph.

• Premises Proof: Latest electricity bill and a valid Rent Agreement (if rented) or NOC from the owner.

For State & Central FSSAI Licenses (Additional Documents):

• Business Registration: Certificate of Incorporation, Partnership Deed, or MSME Udyam Certificate.

• Blueprint: A detailed blueprint/layout plan of the processing unit showing physical dimensions.

• Machinery List: A detailed list of equipment and machinery used, including installed capacity.

• Water Test Report: A recognized laboratory report verifying the safety of water used in food production.

• List of Directors/Partners: Complete contact details and identity proofs of all key management personnel.

• Recall Plan: A formal food safety management system (FSMS) and product recall plan (for Central Licenses).

Processing Time

FoSCoS portal processing times depend on the complexity of the license and the designated food officer’s verification process:

• Basic Registration: Typically approved and issued within 7 to 10 working days.

• State License: Takes approximately 20 to 30 working days (Physical inspection of the premises by a Food Safety Officer is often required before approval).

• Central License: Requires thorough technical vetting and takes about 30 to 45 working days.
